The Supreme Court overturns two of Zaragoza City Council's appeals again, confirming the €50 million debt owed to FCC

  • The two rulings of the Supreme Court, dated 28 March and notified on 4 April to the parties, overturn two separate appeals filed by the City Council of Zaragoza and reinforce the previous ruling, confirming the full effect of the judgments of the High Court of Justice (HCJ) of Aragon on the appropriateness of the price revision associated with the street cleansing and waste collection contract.

The First Section of the Administrative Chamber of the Supreme Court overturned two appeals filed by the City Council of Zaragoza on 28 March 2019, for lack of sufficient grounds, confirming with it the judgments dated 25 June 2018 issued by the Chamber of Administrative Litigation of the HCJ of Aragon on 25 June, which obliges the City Council to review the labour cost of the street cleansing and waste collection contract from 2009 to the present date.

These two rulings are in the same line of the ruling dictated by the same body in mid-March and confirm a debt of the City Council with FCC for an amount of more than €50 million after applying the appropriate annual regularization between 2009 and 2018, as well as that corresponding to 2019. The non-payment of this debt generates daily interest of close to €3,000. 

FCC expresses its willingness and trusts the responsibility of all to seek a solution to this situation.
